Arty class is committed to protecting your personal information and respecting you and your child’s privacy.  

 

By 'your information' we mean any information about you that you or third parties provide to us.

 

This notice contains important information about when and why we collect personal information about you, how we use it, who we may share it with and why, how we keep it safe and secure, and your rights and choices when it comes to the personal information you have given us.

Who we are

 

Arty class is a fine art school for children across Reading and Wokingham, Berkshire dedicated to nurturing your child’s love of art and developing their artistic potential. 

 

In this policy ‘Arty class, ‘we’, ‘us’ or ‘our’ means Arty class Ltd. - a private limited company (no. 15748361). Registered address is: 82A James Carter road, Mildenhall, IP28 7DE.

Principles

 

We will only collect and use your information where we have lawful grounds and legitimate business reasons to do so and will only collect and use the information needed for that particular business purpose, unless you have been informed and, where relevant, your permission obtained.  Where appropropritae we will clearly tell you how we collect and use your information and why.

 

We will review the information we hold and will not retain your information for longer than necessary.  We will also ensure that your information is securely disposed of at the end of the appropriate retention period.

 

We will abide by the General Data Protection Regulation (GDPR) in terms of your rights and rules in general.  

 

We will ensure that we take appropriate security measures for our website and for any personal data that we hold.

 

 

What Information do we collect?

 

We obtain information about you in the following ways:

 

Information you give us directly

 

  • Information that you provide by filling in forms, or using our website www.artyclass.co.uk such as a registration or feedback form. We may also ask you for information when you make an enquiry or report a problem with our site.

  • Information that you provide to us by email, over the phone, by letter, or in person.

  • Information that you provide to us over the telephone or email which we then input on our database.

  • Information you give us indirectly

 

By registering with us, you agree that we may process your data for the purposes outlined in this Privacy notice.

 

Your information may be shared with us by third parties, which might include:

 

  • subcontractors acting on our behalf who provide us with technical, payment or delivery services

  • our business partners, advertising networks analytics providers and search information providers.

  • You should check any privacy policy provided to you where you give your data to a third party.

 

Visiting our website

 

Like many companies we may automatically collect the following information:

 

  • technical information, including the type of device you’re using, the IP address, browser and operating system being used to connect your computer to the internet. This information may be used to improve the services we offer.

  • information about your visit to our website, for example the pages you visit, how long you view certain pages, services you viewed and searched for, referral sources (e.g. how you arrived at our website).

  • We collect and use your personal information by using cookies on our website.

 

Social media

When you interact with us on social media platforms such as Facebook and Twitter we may obtain information about you. The information we receive will depend on the privacy preferences you have set on those types of platforms.

 

What type of information is collected from you?

The personal information we collect, store and use might include:

 

  • Who you are e.g. your name and contact details (e.g. email, telephone and address)

  • Information connected to your enquiry, i.e. location

  • Information on student being enrolled (e.g. name, date of birth, gender, and any other relevant information to the classes. If a student is over 16 years of age, please ensure that you have their permission to share these details with us.

  • The names and telephone numbers of adults you authorise to collect your children or to be contacted in the event of an emergency;

  • Information about your contact with us e.g. phone calls, emails / letters, meetings

  • Information about your activities on our website and about the device used to access it, for instance your IP address and geographical location;

  • Online payments made to Arty class by BACS or Debit Card.   If you make a donation online or make a purchase, your card information is not held by us, it is collected by our third party payment processors, who specialise in the secure online capture and processing of credit/debit card transactions; Arty class does not directly collect, process or store financial information.

  • Any other personal information shared with us.

 

Your sensitive personal data

  • We collect information classified as ‘sensitive’ personal information e.g. relating to a student’s age, health or wellbeing, ethnicity and religion only when it impacts them taking part in a class or event. 

  • Sensitive personal information will only be collected and used where it’s needed to for the benefit of student and teacher. 

  • Sensitive personal information will only be used with your explicit consent and the Data Protection Act requires us to treat any sensitive personal data with a greater level of protection. 

  • Under data protection laws, there may be special situations where we are required to use personal sensitive information, for example, if we need to process it for employment, social security or social protection purposes, your vital interests, or, in some cases, if it is in the public interest for us to do so.  See below section on lawful processing for more information.

  •  

 

 

  • Arty class and its teachers are not required to collate or store any sensitive information about you and your child.  For instance, we do not gather or use information on sexuality, You should not be asked for this information by any of our staff beyond what is outlined above.  If you are, you should email artyclassuk@gmail.com to report. 

  •  

  • to health or sex life, race or ethnic origin, political beliefs or membership, philosophical or religious beliefs, trade union membership and information about the commission of offences and related proceedings.

Photo and video images

Arty class will from time to time take photographs and film footage of students during class time to share with student peers, keep as part of a portfolio, social media, marketing and publicity material (both online and offline). You will be asked for your permission when enrolling your child.  We regularly take photos of art work within the class for our own records and for publicity use (for instance on our website and on social media).  Images of artwork only will not contain any personal or sensitive information.

 

Teachers and Teaching Assistants

If you wish to apply to become a teacher, assistant or volunteer, Arty class will collect details such as your name, contact details, time at your last address, whether you are a car owner, date and place of birth, and details of your hobbies and any training qualifications.

 

We will also collect details of any relevant criminal convictions and will need to see a copy of your DBS certificate before offering you a position.   If we are applying for your DBS, we will need further documents that is required by for the DBS processing but this is not retained by us and just verified and forwarded to the concerned authorities.

 

If you wish to apply to become a teacher through our website, we will collect your name, contact details and information contained in your CV for recruitment purposes. If you provide details of a reference, it is your responsibility to make sure that the person is aware that you have forwarded his/her details for these purposes. If you are taken on by Arty class we will store a scanned copy of the complete DBS certificate and any other relevant certificates or documents ( i.e. First aid)

 

At the application stage we ask applicants if they have had a check, At the interview stage we verify that applicants have a clean background by viewing the certificate and when offered role, a copy is saved. If a role is not available at the time of application, we will store your details for up to 6 years, should a position become available.

 

Other individuals

If you wish to contact us for other purposes, we ask for your contact details so we can respond to your queries. If you contact us about a children’s party, 1 to 1 art lessons, or tutoring we will collect details of the child’s name and date of birth, numbers of children attending and type of party requested, where and when the party is to take place and the parent or guardian's contact details.

 

How will information about you be used and shared?

The information we collect allows us to:

 

  • meet legal, regulatory and compliance requirements including the administration of Arty class, statutory obligations relating to children,

  • ensure that your children are otherwise safe and secure.

  • ensure activities are tailored to your child’s interests or needs

  • Give you details of our classes in your area and other information that you ask for.

  • Provide you with information about our other products and services which may be of interest to you from time to time.

  • provide other art services such as art holiday clubs, exhibitions and arts awards.

  • administer and improve our website/s, classes and services

  • processing bookings or orders that you have submitted;

  • carrying out our obligations under any contracts entered into between you and us;

  • keeping a record of your relationship with us;

  • conduct analysis and market research so we can understand how we can improve;

  • dealing with entries into a competition or event;

  • seeking your views or comments on the services we provide;

  • notifying you of changes to our services;

  • sending you communications which you have requested and that may be of interest to you;

  • processing job applications.

  • have enough information to legally employ the staff.

 

 

How long is your information kept for?

We keep your information for no longer than is necessary for the purposes it was collected for, The length of time we retain your personal information for is determined by operational and legal considerations. For example, we are legally required to hold some types of information to fulfil our statutory and regulatory obligations (e.g. health/safety and tax/accounting purposes).

 

 

Who has access to your information?

We do not sell or rent your information to third parties and we do not share your information with third parties for marketing purposes.

 

However, we may disclose your information to third parties working on our behalf in order to achieve the other purposes set out in this policy, such as third party service providers, suppliers, subcontractors and other associated organisations for the purposes of completing tasks and providing services to you on our behalf (for example to send you mailings).

 

However, when we use these third parties, we disclose only the personal information that is necessary to deliver the services and we have a contract in place that requires them to keep your information secure and prevents them from using it for their own direct marketing purposes.

 

We will not release your information to third parties for them to use for their own purposes, unless we are required to do so by law, for example, by a court order or for the purposes of prevention of fraud or other crime.

 

We may transfer your personal information to a third party as part of a sale of some or all of our business and assets to any third party or as part of any business restructuring or reorganisation, or if we’re under a duty to disclose or share your personal data in order to comply with any legal obligation or to enforce or apply our terms of use or to protect the rights, property or safety of our staff, supporters, customers, users of the website or others. However, we will take steps with the aim of ensuring that your privacy rights continue to be protected.

 

Lawful Processing

Data protection law requires us to rely on one or more lawful grounds to process your personal information. We consider the following grounds to be relevant:

 

Specific consent - Where you have provided consent to us using your personal information in a certain way, such as to send you email, text and/or telephone marketing.

 

Performance of a contract - Where we are entering into a contract with you or performing our obligations under it.

 

Legal obligation - Where necessary so that we can comply with a legal or regulatory obligation to which we are subject, for example where we are ordered by a court or regulatory authority.

 

Vital interests - Where it is necessary to protect life or health (for example in the case of medical emergency suffered by a child at one of our classes) or a safeguarding issue which requires us to share your information with emergency services.

 

Legitimate interests - Where it is reasonably necessary to achieve our or others’ legitimate interests (as long as what the information is used for is fair and does not duly impact your rights).

 

We consider our legitimate interests to be running Arty class as an organisation in pursuit of our aims and values. For example to:

 

  • send communications which we think will be of interest to you;

  • conduct research to better understand who our customers are to better target our marketing;

  • monitor who we deal with to protect us against fraud, money laundering and other risks;

  • enhance, modify, personalise or otherwise improve our services /communications for the benefit of our customers; and

  • understand better how people interact with our website.

  • When we legitimately process your personal information in this way, we consider and balance any potential impact on you (both positive and negative), and your rights under data protection laws. We will not use your personal information where our interests are overridden by the impact on you, for example, where use would be excessively intrusive (unless, for instance, we are otherwise required or permitted to by law).

 

Marketing emails

We may use your contact details to provide you with information about the classes,  courses and parties we offer as well as the products and services you can buy, if we think they may be of interest to you.

 

We will only send you marketing communications if you have provided your prior consent. You may opt out of our marketing communications at any time by clicking the unsubscribe link at the end of our marketing emails.

 

Post/ SMS/ telephone

We do not currently send marketing and fundraising communications by post, SMS or telephone, but would ask permission for these with an opt out option if the situation arises in the future.
